A woman who was shot by a Jefferson County constable in a Walmart parking lot has agreed to settle her lawsuit against the county government.

The county will pay $75,000 in damages to Pedro and Tammie Ortiz on behalf of Constable David Whitlock, who shot Tammie Ortiz in November 2011. That brings the cost of the shooting for Jefferson County taxpayers to six figures, since the county has already paid more than $37,000 to Whitlock’s attorneys.

Kentucky Constables: Untrained And Unaccountable

Jun 8, 2016

EAST BERNSTADT, Ky.—Night had fallen on March 4 when Laurel County Constable Bobby Joe Smith rolled into the parking lot at the A & B Quick Stop.

Smith had received a tip that Brandon Stanley was among the handful of customers mingling inside the convenience store, on a corner of Ky 3094 across from a barrel-making company and a Disciples of God church.

Kentucky lawmakers who advocate abolishing the office of constable are emboldened by a new report from the state justice cabinet calling for just that. Constables have the same law enforcement powers as county sheriffs, but without the specific duties. Like sheriffs, the position is outlined in the constitution. For years, lawmakers have tried to pass a constitutional amendment to end the office. The report said constables have little law enforcement purpose in Kentucky, accounting for .20 of recorded law enforcement in the state.
