Smithland, KY – Defense attorneys for Kevin Wayne Dunlap are seeking to delay his murder trial. Dunlap is accused of stabbing Kristy Frensley and killing her 3 children in their Roaring Springs home more than two years ago. Attorney James Gibson filed a motion this week asking a judge to postpone the trial because DNA testing by the defense had not been finished. The trial is set for February 9 in Livingston County. Commonwealth's Attorney G.L. Ovey filed a counter motion opposing the postponement. Ovey says testimony at a Friday competency hearing will also reveal that further exams of Dunlap, including an MRI requested by the defense, are unnecessary.
