Governor Matt Bevin says a conflict of interest should bar Attorney General Andy Beshear from suing him. Beshear filed a lawsuit last week challenging Bevin's decision to abolish and replace the board of trustees at the University of Louisville.
Bevin's attorneys have asked a judge to disqualify Beshear, saying he is the legal adviser for all state officers.
Last year, former Attorney General Jack Conway issued an advisory opinion that said it was legal for the governor to reorganize the university board.
Bevin said the state's code of professional conduct for attorneys prohibits Beshear from suing the governor for following the former attorney general's advice.
Beshear called the move a "desperate tactic" and said he will not let the governor stop him.
